Swish Analytics, a leading provider of sports betting data and odds, has launched a significant legal battle against OddsJam and OpticOdds, filing a lawsuit in the Superior Court of California. The lawsuit accuses the defendants of misappropriation, “Hot News” misappropriation, restitution, unjust enrichment, and unfair competition related to the alleged theft and resale of Swish’s proprietary sports betting odds.

Swish claims that a substantial portion of OddsJam’s and OpticOdds’ business model relies on “misappropriating Swish’s proprietary odds information” from various sportsbooks and other users of sports odds data. The lawsuit further alleges that the defendants then republish and sell access to this stolen information, directly competing with Swish by offering sportsbooks and other customers access to Swish’s own proprietary data taken from Swish’s sportsbook partner websites. This alleged practice aims to undercut Swish’s market position within the competitive sports betting odds market.

The lawsuit asserts that the damages resulting from this alleged misappropriation amount to “at least” $100 million and are “likely significantly more.” This substantial figure highlights the severity of the alleged infringement and the potential impact on Swish’s business.

Swish Analytics boasts partnerships with major sports betting operators, including FanDuel and bet365, providing odds and data for popular sports like the NFL, NBA, NHL, and others. Earlier this year, Altenar expanded its partnership with Swish Analytics, enhancing its Major League Baseball betting offerings with innovative micro-betting options and fast markets, further cementing Swish’s position in the sports betting industry.

Evidence submitted to the court includes compelling screenshots demonstrating that OpticOdds utilizes the same odds as Swish’s proprietary products across several major sporting leagues. Swish alleges that the defendants “knowingly accessed the computers, computer systems, or computer networks of Swish’s licensees” to unlawfully acquire, copy, and utilize Swish’s proprietary odds information without permission, subsequently selling these stolen odds on their own platforms.

A key element of Swish’s unfair competition argument is that both Swish and the defendants operate in California, providing a strong legal basis for the case.

While OddsJam and OpticOdds have yet to issue a formal statement regarding the lawsuit, a recent LinkedIn post by OpticOdds’ CCO, Ryan Weinstock, indicated the company’s focus on “scaling our marketing efforts and expanding our team to help emerging sportsbooks compete with industry leaders,” a statement that now takes on added significance in light of the legal proceedings.
